Conditions of Entry - Redheads Win a Redheads Winter Jacket Competition
  1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed to be acceptance of these Conditions of Entry.

  3. Entry is only open to Victorian residents aged 15 years and over
  4. Employees (and their immediate families) of the Promoter, its associated companies, advertising agencies and participating retailers are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. The Promoter reserves the right at any time to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who the Promoter believes either has tampered with the entry process or has submitted an entry which is not in accordance with these Conditions of Entry or acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  6. Incomplete, indecipherable or illegible entries will be deemed invalid.
  7. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  8. Promotion ends at close of business on 11/07/10 ('Promotional Period'). All entries via the internet must be received by 11.59pm AEST on 11/07/10.
  9. To enter, a participant must log onto www.redheads.com.au, follow the prompts to the competition entry page and fully complete the online entry form before 11:59pm AEST on 11/07/10;
  10. There is a limit of one (1) entry per person per day via the website. Each entry must be submitted separately and in accordance with the entry requirements.
  11. All website entries are deemed to be received at the time of receipt into the Promoter's database NOT the time of transmission by the entrant.
  12. There are 2 X Redheads Winter Jacket prizes to be won. The total prize value is up to the value of AU$200.
  13. The major prize draw will take place at 12.00noon AEST on 14/07/10 Swedish Match Australia Pty Ltd, 718 Princes Highway, Springvale, Vic 3171. The Promoter will randomly draw two (2) valid entries from all entries received by website. The first two valid entries drawn will win the major prize draw. All winners will be notified by e-mail or letter.
  14. The Promoter's decision is final and no correspondence will be entered into.
  15. The maximum value of the total prize pool is up to RRP AU$200 (including GST).
  16. No responsibility is accepted for late, lost, incomplete, incorrectly submitted, delayed or misdirected entries.
  17. Prizes are not transferable or exchangeable and cannot be taken as cash.
  18. In the event for any reason a winner does not take the prize when specified by the Promoter, then the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. Where a prize is unavailable for any reason, the Promoter may substitute the prize for a prize of equal or higher value and/or specifications, as determined by the Promoter, subject to any written directions from a regulatory authority.
  19. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter, including without limitation technical malfunctions or failures.
  20. The Promoter is not responsible for any technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, or any other technical failures, including any injury or damage to participants' or any other person's computer related to or resulting from participation in or down-loading any materials in this competition.
  21. If for any reason this competition is not capable of running as planned in any respect due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right, subject to the written directions of any relevant authority, in its sole discretion to cancel, postpone or amend the competition, as appropriate.
  22. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry or any instructions or directions on this web site, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  23. Any costs associated with accessing the promotional website are the entrant's responsibility and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website will deem the entry to be invalid. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
    2. any theft, unauthorised access or third party interference;
    3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    4. any tax liability incurred by a winner or entrant; or
    5. use of the prize.
  25. As a condition of accepting any prize, winners may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  26. Each entrant agrees to participate and co-operate in any publicity activities connected with the promotion should he/she be a winner and consents to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner. This may include having photographs/film taken of him/her (and his/her prize) and having his/her name and picture appears in advertising, marketing and publicity material within Australia at the Promoter's sole discretion. Each entrant acknowledges that he/she will not receive any compensation in this regard, and the Promoter will determine, in its absolute discretion, the content, format and style of any material to appear in such publications.
  27. The information in the entries is collected to conduct this promotion and to publicise the details of the winners. If an entrant does not provide the information requested, that entry will not be eligible for the prize draw.
  28. The Promoter may require the winners to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter's absolute discretion.
  29. The Promoter is collecting personal information contained in the entry form for the purposes of conducting this Promotion, including conducting the draw, notifying the winners, and as required, Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, research, profiling and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
